The Battle Over Forced Care in California’s Mental Health Crisis

California continues to grapple with a fundamental tension between individual civil liberties and the urgent need for medical intervention as new mental health laws take effect. Governor Gavin Newsom recently signed several measures intended to streamline how the state handles severe psychiatric crises, including Senate Bill 989, which makes it easier for first responders to petition for CARE Court. This system provides a pathway for those with severe illnesses to enter comprehensive treatment plans voluntarily. Additionally, Assembly Bill 1897 now mandates stricter evaluations of a prisoner’s mental status and potential risk to others before they can be released from state custody.

Despite these wins, a significant push for mandatory screening failed to gain traction. Senate Bill 1016, championed by Senator Catherine Blakespear, would have required county health departments to screen patients for involuntary treatment when voluntary options like CARE Court proved insufficient. The bill faced stiff opposition from groups like the County Behavioral Health Directors Association, who argue that existing twenty four hour mobile crisis teams are already equipped to handle these emergencies and de escalate volatile situations without resorting to forced commitment.

Senator Blakespear remains unconvinced that current safeguards are enough, arguing that many of the most vulnerable residents lack the insight to recognize they are ill. She contends that prioritizing absolute autonomy over intervention often results in people effectively dying on the streets while officials debate their human rights. For Blakespear and her supporters, the inability of a patient to acknowledge their own need for help represents the ultimate form of societal disinvestment, leaving them determined to keep fighting for tools that allow doctors to step in against a patient’s will.

This political deadlock plays out daily on city sidewalks, where residents describe witnessing a slow and painful decline among the unhoused population. Community members in areas like La Jolla report seeing individuals engage in erratic behavior or consume trash for years without any meaningful improvement despite repeated calls for help. Even frontline workers and counselors express mixed emotions; while some fear involuntary treatment could be misused as a tool for social cleansing, others admit that certain clients are too far gone to feed themselves or accept referrals. These providers warn that regardless of whether treatment is voluntary or forced, the state still lacks enough beds and facilities to actually house those it seeks to save.
